Chairperson Tom Mitchell called the meeting to order at 7:07 p.m. and explained that the purpose of the special meeting was to consider a request for a rehearing of Case # 4/11/90–2 SUZY SAN SOUCIE, from the Wilton Board of Selectmen.
Mr. Mitchell noted that this meeting was duly noticed more than 24 hours in advance and that the voting board is the same one that decided the case on 4/11/90.
Mr. Mitchell then read into the record the letter from the Selectmen dated April 25, 1990 (see attached). He explained that the Board must decide whether the information in the letter constitutes new evidence for the Board to consider. Ms. Eckstrom felt that all information stated in the letter was available at the 4/11/90 meeting and therefore there is no new evidence.
Mr. Wellington felt that the information that driveways have never been considered “open space” by the PLanning Board was new information.
Mr. Mitchell reiterated that the interpretation of “open space” was the only issue raised in the letter from the Selecmen and the only evidence that the Board can consider.
Mr. Wellington felt that the Board had grounds to rehear the case.
Mr. Faiman felt that there were no grounds.
Mr. Parker felt that a rehearing would be unfair to the San Soucie’s but also felt that the San Soucie’s did not place the parking area where the Board had asked them to place it at the first hearing on 3/14/90.
