Chairman Faiman called the meeting to order at 7:30 p.m. and announced that Board member Herb Klein had died the previous week. The Board observed a moment of silence in his memory.

Case # 3/10/93–1 BARNETT

Thomas O. & Elizabeth B. Barnett, Isaac Frye Highway, Lot C–073 in the Residential/ Agricultural District, requested a Special. Exception under the terms of Section 5.3.1 of the Wilton Zoning Ordinance to permit a counseling practice as a home occupation in an existing home.

Since there were only four voting Board members present, Mr. Faiman offered the Barnett’s the opportunity to return in a month to have their case heard by a full board of five members. They waived their right and wished to have their case heard this evening.

Elizabeth Barnett explained that she has a counseling practice in one room of her home. There have been and will be no structural changes to the house and there will be no signs erected. There will be no more than one client at a time except for workshops which are held approximately once a month on a weekend. There will be no employees.

Abutter Wil Sullivan stated that the counseling practice has been going on for quite a while and it has proved to be very low impact. His property surrounds the Barnett’s on two sides and he has no objection to granting the Special Exception.

Mr. Faiman read the requirements for granting a Special Exception for Home Occupations (5.3.1). He then read a letter from abutter Gloria Konefal, one Wilton Centre Road, asking the Board to stipulate that no sign ever be erected on that site to advertise a business.

The Board felt that since it is stated in the Barnett’s application that no sign will be erected, any future Special Exception application regarding this site would be referred to this application.

MOTION: Mr. Blanchard moved to approve the application for a Special Exception as presented, seconded by Mr. Mitchell with all in favor.

Mr. Faiman stated that the application was approved unanimously and the applicants will receive a written notice of approval from the Board within a few days. He also stated that the Selectmen, any party to the action or proceedings, or any person affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before March 30, 1993, and must fully specify all grounds on which the rehearing is requested.

MOTION: Mr. Wellington moved to approve the 10/14/92 minutes as written, seconded by Mr. Blanchard with all in favor.
MOTION: Mr. Mitchell moved to adjourn the meeting, seconded by Mr. Blanchard with all in favor.

The meeting was adjourned at 7:41 p.m.
