Zoning Board Minutes

October 11, 1995

VOTING BOARD: Chairperson Neil Faiman; members Tom Mitchell, Carol Roberts & Jim Tuttle.
CLERK: Diane Nilsson
  • Kathleen Lizotte - Special Exception

Mr. Faiman called the meeting to order at 7:40 p.m. and explained to the applicant that only four Board members were present. She could choose to wait until next month in hopes of having a five-member Board hear her case. The applicant chose to go ahead with the four-member Board.

Case #10/11/95 — LIZOTTE

Kathleen Lizotte, Lot H–029–01–2, 22 Pierce Lane, in the Residential District, requested a Special Exception under the terms of sections 5.3.6 and 6.6.1 of the Wilton Zoning Ordinance to permit the operation of an in-home educational program for handicapped preschool children.

Ms. Lizotte wishes to provide a pre-school program in her home for two multi-handicapped children plus her own child and one other child. There is plenty of parking space.

Mr. Mitchell visited the site and confirmed that there is ample parking and ample space inside and stated that this case appears to be a typical day care special exception.

MOTION: Mr. Mitchell moved to accept the application as presented and to approve the special exception, seconded by Mr. Tuttle with all in favor.

Mr. Faiman stated that the applicant will receive written notice of approval in the mail. He further stated that the selectmen, any party to the action or proceedings, or any person affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Tuesday, October 31, 1995, and must fully specify all grounds on which the rehearing is requested. (N. H. RSA 677:22) Mr. Faiman then signed a document from the State asking for ZBA approval.

MINUTES — August 9, 1995

MOTION: Mr. Tuttle moved to approve the 8/9/95 minutes as written, seconded by Ms. Roberts with three in favor and Mr. Mitchell abstaining.

Mr. Faiman reminded Board members about the upcoming Municipal law lecture series.

MOTION: A motion was made and seconded to adjourn the meeting. All were in favor.

The meeting was adjourned at 7:53 p. m.
