November 8, 1995

  • Elizabeth Castro - Special Exception.

Before the meeting began, Mr. Faiman explained to Ms. Castro that only four members of the Board were present. She had the choice of going ahead with the hearing with a four-member Board or waiting until next month when five members might be present. She chose to go ahead with the understand- ing that having a four-member Board could not be used as grounds for a rehearing.

Mr. Faiman called the meeting to order at 7:37 p.m.

Case # 11/8/95–1 CASTRO

Elizabeth Castro, Lot 100, 1 Mather Lane, in the Residential District, requested a Special Exception under the terms of section 5.3.1 of the Wilton Zoning Ordinance to permit an accounting practice as a home occupation.

Mr. Faiman stated that he felt that this low-impact business does not even require a Special Exception.

Mr. Mitchell felt that any business that earns money from the home does require a Special Exception, even if customers do not come to the home.

Ms. Castro stated that although she will usually go out to businesses herself, she may, at sometime, wish to have customers come to her house.

One abutter was present, but no comment was made.

MOTION: Mr. Mitchell moved to accept the application as submitted and grant the Special Exception, seconded by Mr. Tuttle with all in favor.

Mr. Faiman stated that the motion passed unanimously and told Ms. Castro that she will receive a Notice of Decision by mail before her scheduled Planning Board meeting. He further stated that the Selectmen, any party to the action or proceedings, or any person affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before November 28, 1995 and must fully specify all grounds on which the rehearing is requested. (N.H. MINUTES — OCTOBER 11, 1995

MOTION: Mr. Mitchell moved to approve the 10/11/95 minutes as written, seconded by Mr. Tuttle with all in favor.

The meeting was adjourned at 7:45 p.m.
