Agenda Lester W. Hutchinson (owner) & Quinn Bros. Corp. (applicant) - special exception

Mr. Tuttle called the meeting to order at 7:37 p.m. and stated that this was the second in a two-part hearing for a wetland crossing by the applicant. He also explained to the applicant that only a three person board could be found this evening and that the applicant had the option of postponing the hearing for a month in hopes of having a five member board next time. The applicant chose to go ahead with the hearing.

Case# 3/8/00-1 HUTCHINSON/QUINN BROTHERS CORP.

Lester W. Hutchinson (owner) and Quinn Brothers Corporation (applicant) have applied for a special exception under the terms of section 11.4(b) of the Wilton Zoning Ordinance, to permit the placement of a culvert and fill in a wetland area on lot B-5 (near Forest Road, on the Wilton/Lyndeborough Town Line), in order to provide access to the lot.

Mr. Tuttle read section 11.4b from the Wilton Zoning Ordinance. He then read paragraph 3 from a letter dated 4/12/00 from Keach-Nordstrom Associates, who had been hired by the zoning board to review the wetland crossing application. In it, Steven Keach, P.E., states that his company completed an on-site inspection of the wetlands delineation data provided on the project plans, made the opinion that the mapping provided accurately depicts true site conditions, and concluded that no alternative for access appears to exist that does not involve wetlands impacts, therefore the applicant's proposal fulfills the criteria required for the issuance of the special exception 11.4.

Doreece Miller, representing the Wilton Conservation Commission, presented a report to the board, based on her visit, with Commission member Spencer Brookes, to the site. The report concurs with Steven Keach's report but calls attention to one detail. "Page 8, section 13 of the Standard Dredge and Fill application states 'The quality of water entering the site will be the same as the quality of water leaving the site' and management for erosion control and sedimentation will be maintained during construction and when the permanent vegetation is in place so there shouldn't be any impact upon the surface waters." The commission also stated that they would like to monitor the integrity of the stream through nearby wetlands during and after construction of the proposed road and installation of the culvert.

The representative from Quinn Bros. stated that the commission would be welcome to visit the site "anytime."

No other audience members were present.

Motion Mr. Hanisch moved to grant the special exception based on the evaluation by Keach-Nordstrom Associates that states that the application meets the criteria set forth in section 11.4b, seconded by Mr. Spear, with all in favor.

A motion to adjourn was made and seconded. All were in favor and the meeting was adjourned at 7:57 p.m.
