Agenda Corinne Blagbrough – request for rehearing

Mr. Faiman called the meeting to order at 7:05 p.m. and explained that this is an open meeting, not a public hearing, notices were posted last week at both the post office and the Town Hall offices. The purpose of the meeting is to make a decision on a request for reconsideration that was submitted June 10 by Corinne Blagbrough with regard to the ZBA’s denial of her appeal of the Building Inspector’s issuance of a building permit to Shattuck Homes on Lot A—21—2.

The Zoning Board met on May 13, considered the appeal, and decided to deny the appeal and uphold the issuance of the building permit. Ms. Blagbrough submitted the request for reconsideration via a letter that Board members were able to review over the last week.

Mr. Faiman handed out a two-page draft response to the request for the Board members to consider.

Ms. Roberts said that after her review of the Blagbrough letter, she could find no issues or arguments that were either not previously raised or were applicable to the decision, and she suggested that the Board deny the request.

Ms. Eckstrom agreed that she found no new evidence in the letter. As to Ms. Blagbrough’s claim that she was denied a fair hearing because the Zoning Board chairperson, Neil Faiman, had written a draft decision notice prior to the commencement of the meeting, Ms. Eckstrom said that she had no knowledge of a draft decision notice until after the Board had voted to deny the appeal. She felt the Board acted in good faith and made a correct decision.

Mr. Spear said that he spent a great deal of time reviewing both the request for reconsideration and the original appeal from administrative decision, and that he felt that all the issues raised in the request for reconsideration have been addressed.

Motion Ms. Eckstrom moved to deny the request for a rehearing. Mr. Spear seconded the motion and all voted in favor of the denial.

Mr. Faiman said that the Zoning Board has denied the request for reconsideration. If Ms. Blagbrough wishes to appeal the decision of the Zoning Board she has the right, within 30 days, to file an appeal with the NH Superior Court.

The Board discussed the language for the Decision Notice, agreed with the draft that Mr. Faiman had written, as well as the additional paragraph that he verbally suggested.

Motion Mr. Spear moved to accept the language in the written draft decision notice with the additional language that Mr. Faiman suggested. Ms. Eckstrom seconded the motion and all were in favor.
Motion Mr. Spear moved to adjourn the meeting, seconded by Ms. Eckstrom and all in favor.

The meeting adjourned at 7:28 p.m.
