9.0 Prohibited Projects
The Planning Board shall not grant an Excavation Permit under the following conditions.
- The excavation would violate the operational standards of Section 7.0.
- The excavation is located within 50 feet of the boundary of a disapproving abutter or within 10 feet of the boundary of an approving abutter unless approval of a lesser distance is requested by the abutter.
- Issuance of the permit would be unduly hazardous or injurious to the public welfare.
- Existing visual barriers would be removed, except as necessary to provide access to the excavation.
- The excavation would substantially damage a known aquifer, so designated by the United States Geological Survey.
- The excavation is within 150 feet of an existing dwelling or a dwelling for which a building permit has been issued at the time the excavation is begun.
- The excavation requires land use permits from state or federal agencies; the Planning Board may approve the application when all the necessary permits have been obtained.
- The project cannot comply with the reclamation provisions of Sections 6.0 and 8.0.
- The excavation is not permitted by zoning or other applicable ordinance.
