You are hereby notified that the appeal of Anne Roy of a decision of the Board of Selectmen regarding the application of section 8.1 of the Wilton Zoning Ordinance has been granted.
The decision of the Selectmen required that, if Ms. Roy wishes to use the former office building on Lot F-11, 15 Hutchinson Road as a residence, she must obtain a variance to section 8.1 of the Wilton Zoning Ordinance to permit two residences on the lot.
The ZBA finds that the former office building may be used for intermittent residential purposes by a person who is a legitimate resident of the primary residence on the lot, without thereby becoming a second residence. This finding does not permit the use of the former office building as a permanent residence, or its use by a person who is not a legitimate resident of the primary residence.
The application for a variance to Section 8.1 of the Wilton Zoning Ordinance is therefore denied, on the ground that such a variance is not necessary for the use desired by the applicant.
