Case 8/13/97–5
You are hereby notified that the applications of United States Cellular (applicant) and John G. Barnes (owner) for relief under the Wilton Zoning Ordinance for a proposed cellular telephone tower on Lot F-12, Route 101, have been decided as follows:- The Zoning Board of Adjustment has found that the proposed tower is a permissible use in the Industrial District. The requested variance to section 8.1 of the Wilton Zoning Ordinance has therefore been denied, on the grounds that the proposed use is permissible without a variance.
- The requested variance to section 8.2.6 of the Wilton Zoning Ordinance, which restricts structures in the Industrial District to a maximum height of 45 feet, has been granted, subject to the restriction that the proposed tower not exceed 199 feet in height.
- The requested special exception under section 11.4(a) of the Wilton Zoning Ordinance, to allow construction of a driveway that would cross four wetland areas to reach the proposed tower location, has been continued for decision at the September 10, 1997 meeting of the ZBA, as required by the ordinance.
While these decisions recognize the proposed tower as a permissible use, they also explicitly recognize the authority of the Wilton Planning Board to determine all details of the proposed use (including the maximum tower height, subject only to the 199 foot maximum limit) during Site Plan Review.
You are hereby notified that the applications of United States Cellular (applicant) and John G. Barnes (owner) for special exception under section 11.4(a) of the Wilton Zoning Ordinance has been granted. The special exception will allow the construction of a driveway (to a proposed cellular telephone tower on Lot F-12, Route 101) which will cross several wetland areas, as indicated on the plan submitted with the application.
