You are hereby notified that the application of William and Kelly Hoff for an equitable waiver, as provided for in RSA 674:33–a, has been granted.

The equitable waiver legitimizes a garage which was constructed in 1996, 16 feet from a lot line where the ordinance requires a 35 foot setback, on Lot H–93, 1001 Mason Road.

You are hereby notified that the Town of Wilton Zoning Board of Adjustment has denied the request by Ellen O’Shea and Joanne Dufour that the Zoning Board reconsider its grant of an equitable waiver to William and Kelly Hoff.

The equitable waiver legitimizes a garage which was constructed in 1996, 16 feet from a lot line where the ordinance requires a 35 foot setback, on Lot H-93, 1001 Mason Road.

The Zoning Board determined that the decision to grant the waiver was sufficiently justified by the objective evidence of the building permit for the garage, and that additional testimony about the circumstances of the granting of the building permit was unlikely to affect that decision.

This decision may be appealed to the Superior Court no later than Friday, December 30, 2000 (N.H. RSA 677:2-4).
