Case 8/12/03–1

You are hereby informed that the application of L.A. Limousine Service for variances to sections 5.2.3 and 16.2.1.2 of the Wilton Zoning Ordinance have been granted, but that their application for a variance to section 16.1(h)(4) has been denied.

The granted variances will permit the erection of a sign on Lot L–27, 223 Gibbons Highway (NH Route 101). A photograph of the proposed sign was presented to the Zoning Board and is in the ZBA case file. The sign is approximately 4.4 by 4.8 feet in size and will be closer to the lot line than would otherwise be permitted. The sign is to be placed behind the mailbox, in line with the stockade fence and tree line, and is not to intrude into the state highway right–of–way. It is not to be illuminated after 10:00 pm.

The denied variance would have permitted the sign to be internally illuminated. The Zoning Board heard no evidence of any hardship that would justify the variance, and found that granting the variance would be inconsistent with the spirit of the ordinance, which was amended in 2001 to prohibit internally illuminated signs in all parts of the town.

This decision shall expire on Friday, August 12, 2005 if the sign has not been erected by that date. (Wilton Zoning Ordinance section 17.4).
