October 12, 2004 — Decision
You are hereby informed that on October 12, 2004, the Wilton Zoning Board declined to consider the application of Donald and Maria Nadeau for a special exception under the terms of section 17.3 of the Wilton Zoning Ordinance.
If granted, the special exception would have permitted the construction of a garage on Lot F–48–3, 86 Intervale Road, which would be closer to a lot line than otherwise permitted by the Ordinance.
The Zoning Board declined to consider the special exception because the lot dimensions and existing structure which resulted in the difficulty were not in existence prior to the adoption of the setback requirements to be reduced, as required by paragraph 17.3(a).
The Zoning Board agreed to waive the application fee for the Nadeaus to submit an application for a variance to allow the same proposed construction.
