Tuesday, June 13, 2006 — Notice
Margaret O’Leary has applied for a variance to Sections 5.1(d) and 6.2.1 of the Wilton Zoning Ordinance, to permit the use of an existing cottage on Lot H–37, 540 Abbot Hill Road, as a second dwelling on the lot.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, June 13, 2006 at 7:30 p.m.
The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.
Tuesday, June 13, 2006 — Continuation
The application by Margaret O’Leary for a variance to Sections 5.1(d) and 6.2.1 of the Wilton Zoning Ordinance has been continued to the Monday, June 19 meeting of the the Zoning Board. If granted, the variance would permit the use of an existing cottage on Lot H–37, 540 Abbot Hill Road, as a second dwelling on the lot.
The Board intends to continue hearing Case #5/9/06–2 from 7:30 to 9:00 p.m., and to hear this case and Case #6/13/06–2 starting at 9:00.
Monday, June 19, 2006 — Decision
The application by Margaret O’Leary for a variance to Sections 5.1(d) and 6.2.1 of the Wilton Zoning Ordinance has been denied. The variance, if granted, would have permitted the use of an existing cottage on Lot H–37, 540 Abbot Hill Road, as a second dwelling on the lot. The Zoning Board denied the application because the proposed use conflicted with the spirit of the ordinance, as expressed in the explicit prohibition against having more that one dwelling on a lot, and because the applicant failed to demonstrate any hardship.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Tuesday, July 18, 2006, and must fully specify all grounds on which the rehearing is requested.
