Tuesday, September 12, 2006 — Notice

Nancy A. Millward (owner) and Stephen A. Buonamano (applicant) have applied for a variance to section 6.2.5 of the Wilton Zoning Ordinance, to permit the installation of a septic system disposal field in the setback on Lot B–131, 956 Isaac Frye Highway.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in in the Wilton Town Hall Courtroom on Tuesday, September 12, 2006 at 7:30 p.m.

The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

Tuesday, September 12, 2006 — Decision

The application by Nancy A. Millward (owner) and Stephen A. Buonamano (applicant) for a variance to section 6.2.5 of the Wilton Zoning Ordinance has been granted. The variance will permit the installation of a septic system disposal field in the setback on Lot B–131, 956 Isaac Frye Highway, as shown on the plan submitted with the application.

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, October 12, 2006, and must fully specify all grounds on which the rehearing is requested. Tuesday, October 10, 2006 — Decision

The Wilton Zoning Board has denied the request by Audrey Robinson that it hold a new hearing to reconsider its September 12 decision, in which it granted Nancy A. Millward's and Stephen A. Buonamano's application for a variance to section 6.2.5 of the Wilton Zoning Ordinance, to permit the installation of a septic system disposal field in the setback on Lot B–131, 956 Isaac Frye Highway.

Contrary to the assertions in the request for the rehearing, the members of the Zoning Board were persuaded by the evidence presented in the September 12 hearing that there was no reasonable alternative location for a septic system disposal field on the property. Also, with regard to point 5 of the request, the Board found the plan and measurements prepared by a registered engineer to be more credible than the report of inconsistencies measured by Ms. Robinson’s daughter.

The application and abutter fees submitted with the request for a rehearing will be returned to the requestor.

This decision may be appealed to the superior court on or before Thursday, November 9, 2006. (N.H. RSA 677:2)
