Tuesday, July 10, 2007 — Notice

Hillside of Wilton, LLC, has applied for a variance to section 6.3.5(a) of the Wilton Zoning Ordinance to permit six lots to be accessed by a single private way in connection with a proposed subdivision of Lot D–84, Pead Hill Road, and also for a special exception under section 11.4 of the Ordinance, to permit the private way and driveways to cross wetland areas on the property.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in in the Wilton Town Hall Courtroom on Tuesday, July 10, 2007 at 7:30 p.m.

The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

Tuesday, July 10, 2007 — Continuation

The hearing on the application by Hillside of Wilton, LLC for a variance to section 6.3.5(a) of the Wilton Zoning Ordinance and a special exception under section 11.4 of the Ordinance has been continued to the Tuesday, August 14 meeting of the Zoning Board. If granted, the variance would permit six lots to be accessed by a single private way in connection with a proposed subdivision of Lot D–84, Pead Hill Road, and the special exception would permit the private way and driveways to cross wetland areas on the property.

Members of the Board will hold a site visit at the property at 10:00 a.m. on Saturday, August 4. The Board will send the application to LaBombard Engineering for independent review. The Board has also requested that the applicant provide more details about the proposed wetland crossings, and more information on the plan for diversion of runoff water away from the road at the bottom of the drive.

Tuesday, August 14, 2007 — Continuation

The hearing on the application by Hillside of Wilton, LLC, has been continued to the September 11, 2007 meeting of the ZBA at the request of the applicants, to allow them additional time to prepare information that was requested by the Zoning Board at its July 10 meeting and have it reviewed by the Board’s engineer. The application is for a variance to section 6.3.5(a) of the Wilton Zoning Ordinance to permit six lots to be accessed by a single private way in connection with a proposed subdivision of Lot D–84, Pead Hill Road, and also for a special exception under section 11.4 of the Ordinance, to permit the private way and driveways to cross wetland areas on the property.

Tuesday, September 11, 2007 — Decision

The application by Hillside of Wilton, LLC for a variance to section 6.3.5(a) of the Wilton Zoning Ordinance and for a special exception under section 11.4 of the Ordinance has been granted. The variance will permit six lots to be accessed by a single private way in connection with a proposed subdivision of Lot D–84, Pead Hill Road, and the special exception will permit the private way to cross wetland areas on the property as shown on the plan dated August 7, 2007.

The Zoning Board emphasizes that its decision is limited to the specific questions of the requested variance and special exception, and does not constitute an opinion on the merits of the development as a whole.

This decision shall expire if the construction or use permitted by it has not begun by Friday, September 11, 2009. (Wilton Zoning Ordinance section 17.4)

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, October 11, 2007, and must fully specify all grounds on which the rehearing is requested.
