Tuesday, September 11, 2007 — Notice

Richard L. Sharkey has applied for a variance to section 8.2.2 of the Wilton Zoning Ordinance to permit a lot line adjustment and subdivision of Lots F–23 and F–24, 369 Gibbons Highway, where one of the resulting lots would have less than the required frontage, and for variances to sections 8.1 and 8.5 of the Ordinance to allow the residential use of both lots, which is not a permitted use in the Industrial District.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in in the Wilton Town Hall Courtroom on Tuesday, September 11, 2007 at 7:30 p.m.

The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

Tuesday, September 11, 2007 — Continuation

The application by Richard L. Sharkey for variances to section 8.2.2, 8.1, and 8.5 of the Wilton Zoning Ordinance has been continued to the Tuesday, Seeptember 25 meeting of the Zoning Board. If granted, the variance would permit a lot line adjustment and subdivision of Lots F–23 and F–24, 369 Gibbons Highway, where one of the resulting lots would have less than the required frontage, and would allow the residential use of both lots, which is not a permitted use in the Industrial District.

Tuesday, September 25, 2007 — Decision

The application by Richard L. Sharkey for variances to sections 8.1, 8.5, and 8.2.2 of the Wilton Zoning Ordinance has been granted. In connection with a proposed lot line adjustment between lots F–23 and F–24, 369 Gibbons Highway, as shown on the plans submitted to the Zoning Board, the variances will permit the construction of a house on the resulting north-eastern lot, and will allow the resulting north-eastern lot to have only the frontage on NH Route 101 that Lot F–23 has at present. However, if the north-eastern lot is ever used for non-residential purposes, it must be reconfigured to meet the normal frontage requirements of the Industrial District.

This decision shall expire if the construction or use permitted by it has not begun by Friday, September 25, 2009. (Wilton Zoning Ordinance section 17.4)

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, October 25, 2007, and must fully specify all grounds on which the rehearing is requested.
