Tuesday, September 11, 2007 — Notice
Kevin J. Degroot has applied for variances to section 5.2.1 of the Wilton Zoning Ordinance to permit the conversion of the existing building on Lot J–16, 9 Dale Street (“The Odd Fellows Hall”) for three-family residential use, where the ordinance would only allow a single-family home, and to section 5.2.3 of the Ordinance, to permit parking in the lot setback area (or alternatively for a determination from the Zoning Board that parking is permitted in the setback area). (This is a new application requesting different relief from the Zoning Ordinance, to allow essentially the same use originally proposed in the application for Case 7/10/07–3.)
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in in the Wilton Town Hall Courtroom on Tuesday, September 11, 2007 at 7:30 p.m.
The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.
Tuesday, September 11, 2007 — Continuation
The application by Kevin J. Degroot for variances to section 5.2.1 and 5.2.3 of the Wilton Zoning Ordinance has been continued to the Tuesday, October 9 meeting of the Zoning Board, to allow the applicant to prepare documentation to support the assertion that its proposed residential conversion would be financially infeasible with less than three dwelling units.
If granted, the variances would permit the conversion of the existing building on Lot J–16, 9 Dale Street (“The Odd Fellows Hall”) for three-family residential use, where the ordinance would only allow a single-family home, and would permit parking in the lot setback area.
Tuesday, October 9, 2007 — Decision
The application by Kevin J. Degroot for variances to section 5.2.1 and 5.2.3 of the Wilton Zoning Ordinance has been granted. The variances will permit the conversion of the existing building on Lot J–16, 9 Dale Street (“The Odd Fellows Hall”) to three two-bedroom residential units, and will allow parking for six cars in the setback, as shown on the plan titled “Proposed Parking Concept 'B', Lot J–16, 9 Dale Street, Wilton, New Hampshire,” dated October 8, 2007, or as it may be amended to comply with requirements imposed by the Planning Board.
This decision shall expire if the construction or use permitted by it has not begun by Friday, October 9, 2009. (Wilton Zoning Ordinance section 17.4)
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, November 8, 2007, and must fully specify all grounds on which the rehearing is requested.
