Tuesday, October 9, 2007 — Notice

E&T‘s United Venture, Inc. (owner) and L.A. Limousine Service, Inc. (applicant) have applied for: (1) variances to sections 5.2.3 and 11.6 of the Wilton Zoning Ordinance, to allow the parking of one bus along the property line, and the placement of drainage structures within the wetland setback area, on Lot L–27, 223 Gibbons Highway; (2) variances to sections 5.2.3 and 16.2.1.2 of the Ordinance, to allow for the construction of a sign on the property larger than allowed by the Ordinance; (3) a variance to section 5.1 of the Ordinance, to allow the use of a parcel of land recently added to Lot L–27 in accordance with the variance granted in ZBA Case #7/11/97–2, which allowed the use of Lot L–27 “for an office and garage for the rental of motor vehicles and transportation services (limousine service) and light vehicle repairs.”

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, October 9, 2007 at 7:30 p.m.

Tuesday, October 9, 2007 — Continuation

The hearing on the application by E&T‘s United Venture, Inc. (owner) and L.A. Limousine Service, Inc. (applicant) for variances to sections 5.2.3, 11.6, 16.2.1.2, and 5.1 of the Wilton Zoning Ordinance has been continued to the Tuesday, November 13, 2007 meeting of the Zoning Board.

Saturday, November 3, 2007 — Site Visit

The Zoning Board will meet L.A. Limousine, 223 Gibbons Highway at 9:00 a.m. on Saturday, November 3, 2007 to hold a site visit for this application.

The site visit is a continuation of the public hearing on the case, and is open to the public. Its purpose is to assist the Board members and other interested parties to become familiar with the property involved in the application. Board members and other interested parties may, through the Board chairperson, ask questions about, and the applicant may point out, site details pertaining to the application, such as boundaries, contours, proposed buffers, driveways, etc. No other testimony will be taken, and no other discussion should occur.

Tuesday, November 13, 2007 — Decision

The application by E&T‘s United Venture, Inc. (owner) and L.A. Limousine Service, Inc. (applicant) for variances to sections 5.1, 5.2.3 and 11.6 of the Wilton Zoning Ordinance has been granted. The variances will permit the use of lot L–27, 223 Gibbons Highway, including the newly addded “Parcel A” for an office and garage for the rental of motor vehicles and transportation services (limousine service) and light vehicle repairs, and the parking of one or two “buses” (bus-size limousines) in the setback along the west side of the property, all as shown on the plan labeled “Conceptual Non-Residential Site Plan, Lot L–27, E&T’s United Venture, Inc., October 9, 2007 (amended 11-13-07),” as submitted or as it may be amended during site plan review with the Wilton Planning Board, except that the “existing” and “future” bus parking areas shown on the plan are to be interchanged.

The variances are granted subject to the following conditions:

The hearing on the requested variances to sections 5.2.3 and 16.2.1.2 of the Ordinance to permit a sign that is larger and closer to the highway than permitted by the Ordinance has been continued to Tuesday, December 11, to allow the applicant to submit a photo of the sign and scale drawings with measurements and exact location shown on the plan, showing the sign both if limited to the height allowed in the residential district and at the applicant's requested height. The continued case will be noticed as Case #12/11/07–1.

This decision shall expire if the construction or use permitted by it has not begun by Friday, November 13, 2009. (Wilton Zoning Ordinance section 17.4)

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, December 13, 2007, and must fully specify all grounds on which the rehearing is requested.
