Tuesday, October 9, 2007 — Notice
In conjunction with the application in ZBA Case #9/11/07–1 for a variance or special exception to permit a reduced setback for a proposed residential use of the existing barn on Lot L–5, Seagroves Road, Kenneth Cadrain has requested a variance or finding from the Zoning Board to release the deed restriction on the property, imposed by the ZBA as part of a decision in 1979, that the barn could never be used as a residence.
This request will be consolidated with and heard together with Case #9/11/07–1.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, October 9, 2007 at 7:30 p.m.

Tuesday, October 9, 2007 — Decision
The Wilton Zoning Board has released the deed restriction that it required as a condition for the granting of a variance in 1979, which stated that the barn on Lot L–5, Seagroves Road, could never be used as a residence. The ZBA found that, due to changes in conditions since 1979, residential use of the barn would conform to the Zoning Ordinance, and that the deed restriction therefore serves no purpose, subject to the conditions that
- sufficient land be added to the lot (by a lot line adjustment) to bring the lot size up to the 0.5 acres required for a single-family residence,
- the applicant receives the special exception requested in ZBA Case #9/11/07–1, to permit the residential use of the barn, even though it is closer to a lot line than is otherwise permitted by the Ordinance, and
- any residence on the property makes use of Town sewer and water.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, November 8, 2007, and must fully specify all grounds on which the rehearing is requested.
