The Pierre E. Provost IV 1993 Trust & Lura S. Provost 1993 Trust have applied for a special exception under section 11.4 of the Wilton Zoning Ordinance to permit roadways and drainage improvements which will affect wetland areas as part of a proposed subdivision of Lot B–14, Cram Hill Road (Lyndeborough) and Lyndeborough Tax Map 238, Lot 19 into 14 residential lots.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, November 13, 2007 at 7:30 p.m.
The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

The hearing on the application by the Pierre E. Provost IV 1993 Trust & Lura S. Provost 1993 Trust for a special exception under section 11.4 of the Wilton Zoning Ordinance has been continued to the December 11 meeting of the Zoning Board. If granted, the special exception will permit roadways and drainage improvements which will affect a wetland area as part of a proposed subdivision of Lot B–14, Cram Hill Road (Lyndeborough) and Lyndeborough Tax Map 238, Lot 19 into 14 residential lots.
Tuesday, December 11, 2007 — Decision
The application by the Pierre E. Provost IV 1993 Trust & Lura S. Provost 1993 Trust for a special exception under section 11.4 of the Wilton Zoning Ordinance has been granted. The special exception will permit a wetland impact resulting from the construction of a roadway as part of a proposed subdivision of Lot B–14, Cram Hill Road (Lyndeborough) and Lyndeborough Tax Map 238, Lot 19 into 14 residential lots, as shown on the plan submitted with the application.
Specifically, a wetland impact of up to 2703 square feet is permitted for the roadway crossing, preferably with a bottomless culvert as proposed in the plan submitted to the Zoning Board in February 2007 rather than the drop culvert proposed in the plan submitted in November 2007. The Zoning Board encourages the Conservation Commission to communicate with the state Wetland Bureau to argue the case for a bottomless culvert or other alternative to the proposed drop culvert.
This decision shall expire if the construction or use permitted by it has not begun by Friday, December 11, 2009. (Wilton Zoning Ordinance section 17.4)
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, January 10, 2008, and must fully specify all grounds on which the rehearing is requested.
