Tuesday, November 13, 2007 — Notice

Oak Lane Holdings, LLC (owner) and Premier Concrete Construction, LLC (applicant) have appealed an administrative decision of the Wilton Code Enforcement Officer that the erection of a concrete / fenced structure on Lot F–170, 614 Gibbons Highway required site plan approval and a building permit under Article 1.0 of the Wilton Site Plan Regulations. Alternatively, they have submitted an application for an equitable waiver to sections 8.2.4 and 11.6 of the Wilton Zoning Ordinance for the fence / structure.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, November 13, 2007 at 7:30 p.m.

The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

Tuesday, November 13, 2007 — Continuation

The hearing on the application by Oak Lane Holdings, LLC (owner) and Premier Concrete Construction, LLC (applicant) for an administrative appeal, or alternatively for an equitable waiver to sections 8.2.4 and 11.6 of the Wilton Zoning Ordinance, has been continued to the December 11 meeting of the Zoning Board. The appeal is to a decision of the Wilton Code Enforcement Officer that the erection of a concrete / fenced structure on Lot F–170, 614 Gibbons Highway required site plan approval and a building permit under Article 1.0 of the Wilton Site Plan Regulations, and the equitable waiver would retroactively approve the construction.

Tuesday, December 11, 2007 — Decision

The appeal by Oak Lane Holdings, LLC (owner) and Premier Concrete Construction, LLC (applicant) of an administrative decision of the Wilton Code Enforcement Officer has been granted in part. The administrative decision held that the erection of a concrete / fenced structure on Lot F–170, 614 Gibbons Highway required site plan approval and a building permit under Article 1.0 of the Wilton Site Plan Regulations.

The Zoning Board finds that the fence and supporting concrete structure on Lot F-170 is not a building, as defined by Section 3.1.5 of the Ordinance, and therefore is not governed by the requirements of Section 4.6.7.

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, January 10, 2008, and must fully specify all grounds on which the rehearing is requested.
