Tuesday, January 8, 2008 — Notice

Randy and Catherine Caswell have applied for a special exception under Chapter 17 and for a variance to sections 17.2 and/or 17.3 of the Wilton Zoning Ordinance, to permit the reconstruction of a nonconforming multi-family residence which was destroyed by fire on Lot J–124, 4 Barry Court, in a different location than the original structure.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Selectmen’s Office in the Wilton Town Hall on Tuesday, January 8, 2008 at 7:30 p.m.

The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

Tuesday, January 8, 2008 — Decision

The application by Randy and Catherine Caswell for variances to sections 17.2 and 17.3 of the Wilton Zoning Ordinance has been approved. The variances will permit the reconstruction of a nonconforming three-family residence which was destroyed by fire on Lot J–124, 4 Barry Court, with a slightly different footprint and in a slightly different location on the lot, which does not satisfy the setback requirements of the Zoning Ordinance, as shown on the plan labeled “Certified Plot Plan / Tax Map J Lot 124 / Wilton, New Hampshire (Dated 1/3/08)” with a hand-drawn annotation added by the applicant.

This decision shall expire if the construction or use permitted by it has not begun by Friday, January 8, 2010. (Wilton Zoning Ordinance section 17.4)

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, February 7, 2008, and must fully specify all grounds on which the rehearing is requested.
