Tuesday, August 9, 2011 — Notice

Abby MacFarland has applied for an Equitable Dimensional Waiver under RSA 674:33–a for an already erected steel hoop structure that is within the 35 foot set back from the rear property line on lot F-166, 572 Gibbons Hwy. She has additionally requested a variance to 8.2.8 of the Wilton Zoning ordinance, to allow a second curb cut onto NH Route 101, locally known as Gibbons Highway.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, August 9, 2011 at 7:30 p.m.

Tuesday, August 9, 2011 — Decision

The application by Abby MacFarland for an Equitable Dimensional Waiver under RSA 674:33–a has been granted. The waiver will permit an already erected steel hoop structure that intrudes by 2½ feet into the 35 foot setback from the rear property line on lot F–166, 572 Gibbons Highway. This decision does not affect whether the proposed use of the building is permitted, or the requirement for a building permit or site plan review, or any other proceedings relating thereto.

The application by Abby MacFarland for a variance to section 8.2.8 of the Wilton Zoning ordinance has been granted. The variance will allow a second curb cut onto NH Route 101 from Lot F–166, 572 Gibbons Highway, as shown on the plan which is part of the case file. The new curb cut is to be used only for the proposed commercial use of the lot. The existing curb cut is to be used only for the existing residential use. Access to the existing agricultural use on the lot is to be only by the existing right-of-way over Lot F–166–1 from Rroute 31.

This decision shall expire if the construction or use permitted by it has not begun by Friday, August 9, 2013. (Wilton Zoning Ordinance section 17.4)

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, September 8, 2011, and must fully specify all grounds on which the rehearing is requested.
