Tuesday, October 11, 2011 — Notice
Jared Brown has applied for a variance to section 5.2.3 of the WIlton Zoning Ordinance, to permit the relocation of an existing shed to the north (back right) corner of Lot K-110, 10 Putnam Street, where it would be closer to the side and back lot lines than is permitted by the ordinance.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, October 11, 2011 at 7:30 p.m.

Tuesday, October 11, 2011 — Continuation
The hearing on the application by Jared Brown for a variance to section 5.2.3 of the WIlton Zoning Ordinance has been continued to Tuesday, November 8, 2011. If granted, the variance would permit the relocation of an existing shed to the north (back right) corner of Lot K-110, 10 Putnam Street, where it would be closer to the side and back lot lines than is permitted by the ordinance. The purpose of the continuation is to allow for the applicant to prepare a sketch plan of the property and its surroundings, and for a site visit.
Saturday, October 22, 2011 — Site Visit
The Zoning Board will meet at 10 Putnam Street at 9:00 a.m. on Saturday, October 22, 2011 to hold a site visit for this application.
The site visit is a continuation of the public hearing on the case, and is open to the public. Its purpose is to assist the Board members and other interested parties to become familiar with the property involved in the application. Board members and other interested parties may, through the Board chairperson, ask questions about, and the applicant may point out, site details pertaining to the application, such as boundaries, contours, proposed buffers, driveways, etc. No other testimony will be taken, and no other discussion should occur.
Tuesday, November 8, 2011 — Decision
The application by Jared Brown for a variance to section 5.2.3 of the WIlton Zoning Ordinance has been denied. If granted, the variance would have permitted the placement of a shed in the north (back right) corner of Lot K-110, 10 Putnam Street, where it would be closer to the side and back lot lines than is permitted by the ordinance.
The ZBA found that there was no hardship: the inability to place the shed in the desired location does not seriously injure the applicant, because there are reasonable alternative locations for the shed on the property that satisfy the setback requirements, there are no special conditions of the property which preclude placing the shed in a permitted location, and not having the shed at all is not an unreasonable deprivation. The ZBA also found that the visual impact on adjacent properties resulting from placing the shed too close to the lot lines would be inconsistent with the spirit of the ordinance’s setback requirement.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, December 8, 2011, and must fully specify all grounds on which the rehearing is requested.
