Case 10/13/99–2
With regard to the appeal by Richard A. Keyes of an administrative decision pertaining to section 4.7.1 of the Wilton Zoning Ordinance, to allow him to temporarily place a manufactured home on Lot C-23-7, Goldsmith Road, during the construction of a permanent dwelling on the lot, the Zoning Board of Adjustment has made the following findings:
- that the text of Section 4.7 of the Zoning Ordinance prior to March of 1999 included the provision that "The Building Inspector may grant a permit to temporarily locate a manufactured home on the same lot as a permanent dwelling or building for a period of up to twelve months while a dwelling is being initially constructed or substantially reconstructed; or any building is being reconstructed after damage by fire or other natural cause;"
- that Article 7 on the Wilton Town Meeting warrant in March of 1999 stated that Section 4.7 was to be revised, and that the revised text of Section 4.7 "shall contain the current ordinance for the temporary placement of manufactured homes as dwellings" (i.e., Section 4.7 as it existed up to that time);
- that it was the clear intention of the Planning Board and the Town Meeting that Section 4.7 of the Wilton Zoning Ordinance should continue to include the text "The Building Inspector may grant a permit to temporarily locate a manufactured home on the same lot as a permanent dwelling or building for a period of up to twelve months while a dwelling is being initially constructed or substantially reconstructed; or any building is being reconstructed after damage by fire or other natural cause," and the omission of the phrase "while a dwelling is being initially constructed" from the subsequently published text of the ordinance is a clerical error;
- that Mr. Keyes is therefore permitted to place a manufactured home on Lot C-23-7, Goldsmith Road, for no more than twelve months (with a possible extension of six months in case of hardship) during the construction of a permanent dwelling on that lot.
