Tuesday, January 11, 2005 — Decision
You are hereby informed that the appeal by Corinne Blagbrough of a decision of the Wilton Building Inspector has been denied. The decision was to issue a building permit for a storage/workshop building with garage on Lot A–21–2, Burton Highway, and the Zoning Board has upheld that decision.
The Zoning Board considered all of the claims in the appeal that the proposed construction violated provisions of the Wilton Zoning Ordinance, and did not agree with any of them.
The Zoning Board found that the Building Inspector’s decision that the proposed construction does not violate any wetland setbacks was based on his own investigation and on credible evidence that he had received, and that no evidence to the contrary had been offered.
The Zoning Board did not consider claims of violations of New Hampshire DES and DOT regulations, because those claims fall outside the Zoning Board’s jurisdiction, as set forth in RSA 674:33 and RSA 676:5.
(Decided Tuesday, January 11, 2005)
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Wednesday, February 9, 2005, and must fully specify all grounds on which the rehearing is requested.
