Case 2/14/06–1

Tuesday, February 14, 2006 — Notice

Matthew and Carol Ballou have applied for a special exception under section 17.2 or 17.3 of the Wilton Zoning Ordinance, or alternatively for a variance to section 5.2.3 of the Ordinance, to allow them to renovate an attached barn on Lot L–58, 14 Kennedy Street, into finished living space, where the barn is closer to a lot line than is permitted by the Zoning Ordinance.

The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, February 14, 2006 at 7:30 p.m.

The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.

Tuesday, February 14, 2006 — Decision

The Wilton Zoning Board has found that Matthew and Carol Ballou have the right to convert space in the existing attached barn on Lot L–58, 14 Kennedy Street, for use as additional living space for their single-family home, so long as the footprint of the structure is unchanged. The Zoning Board therefore took no action on the Ballou’s applications for a variance to section 5.2.3 of the Zoning Ordinance or a special exception under section 17.2 or 17.3 of the Ordinance, and the Building Inspector is authorized to issue a building permit for the proposed renovations with no need for further action by the Zoning Board.

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Wednesday, March 15, 2006, and must fully specify all grounds on which the rehearing is requested.
