Tuesday, September 12, 2006 — Notice
Matthew R. Harwood has applied for a variance to sections 5.2.1 and 5.2.2 of the Wilton Zoning Ordinance, to permit the subdivision of Lot L–28, 235 Gibbons Highway, into two lots, one of which would have less area and frontage than required by the Ordinance.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in in the Wilton Town Hall Courtroom on Tuesday, September 12, 2006 at 7:30 p.m.

Tuesday, September 12, 2006 — Continuation
The hearing on the application by Matthew R. Harwood for a variance to sections 5.2.1 and 5.2.2 of the Wilton Zoning Ordinance has been continued to the Tuesday, October 10 meeting of the Zoning Board. If granted, the variance would to permit the subdivision of Lot L–28, 235 Gibbons Highway, into two lots, one of which would have less area and frontage than required by the Ordinance.
Tuesday, October 10, 2006 — Continuation
The application of Matthew R. Harwood for a variance to sections 5.2.1 and 5.2.2 of the Wilton Zoning Ordinance has been continued to the November 14 meeting of the Zoning Board. If granted, the variance would permit the subdivision of Lot L–28, 235 Gibbons Highway, into two lots, one of which would have less area and frontage than required by the Ordinance.
Because an unknown portion of Lot L–28 is reported to have been filled in the past, the Board has requested that the applicant provide an engineering report on the nature of the soil and its suitability for construction, in the proposed new house location and the area around it. This report is to be based on soil studies and test pits. The Board has deferred further discussion of the requested variance until it has received this report.
Tuesday, November 14, 2006 — Decision
You are hereby informed that the application by Matthew R. Harwood for a variance to sections 5.2.1 and 5.2.2 of the Wilton Zoning Ordinance has been granted. The variance will permit the subdivision of Lot L–28, 235 Gibbons Highway, into two lots, and permit the use of the existing house on one of the resulting lots as a two-family house, and will permit the construction of a new two-family house on the other lot. The variance is granted with the following restrictions:
- The two lots are to be accessed by a single shared driveway access to Gibbons Highway (NH Route 101).
- Any new construction on either of the lots is to be conducted in accordance with the recommendations of the letter dated November 13, 2006 from Monadnock Survey to the Zoning Board, signed by Dawn Tuomala.
- This notice of decision, including these restrictions, must be filed with the deeds to the two subdivided lots in the Registry of Deeds.
This decision shall expire if the construction or use permitted by it has not begun by Friday, November 14, 2008. (Wilton Zoning Ordinance section 17.4)
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, December 14, 2006, and must fully specify all grounds on which the rehearing is requested.
