Tuesday, February 13, 2007 — Notice
The Pierre E. Provost IV 1993 Trust and the Lura S. Provost 1993 Trust have applied for a special exception under Section 11.4 of the Wilton Zoning Ordinance, to permit the construction of driveways and drainage improvements impacting 9544 square feet of wetlands as part of a proposed subdivision of Lot B–14 (accessed from Cram Hill Road, Lyndeborough).
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in in the Wilton Town Hall Courtroom on Tuesday, February 13, 2007 at 7:30 p.m.

Tuesday, February 13, 2007 — Continuation
The hearing on the application by the Pierre E. Provost IV 1993 Trust and the Lura S. Provost 1993 Trust have applied for a special exception under Section 11.4 of the Wilton Zoning Ordinance has been continued to the Tuesday, March 20 meeting of the Zoning Board. In the interim, the applicant will meet with the Conservation Commission, and the Zoning Board will submit the application for review by the Town’s consulting engineer. If granted, the special exception will permit the construction of driveways and drainage improvements impacting 9544 square feet of wetlands as part of a proposed subdivision of Lot B–14 (accessed from Cram Hill Road, Lyndeborough).
Tuesday, March 20, 2007 — Continuation
The hearing on the application by the Pierre E. Provost IV 1993 Trust and the Lura S. Provost 1993 Trust for a special exception under Section 11.4 of the Wilton Zoning Ordinance has been continued to the Tuesday, May 8 meeting of the Zoning Board. In the interim, the Zoning Board will participate in a multi-board site walk of the subject property at 10:00 a.m. on Saturday, April 14, and will ask the town Road Agent for his preferences on retaining walls versus sloped embankments for the road crossings. If granted, the special exception will permit the construction of driveways and drainage improvements impacting 9544 square feet of wetlands as part of a proposed subdivision of Lot B–14 (accessed from Cram Hill Road, Lyndeborough).
Tuesday, May 8, 2007 — Decision
The application by the Pierre E. Provost IV 1993 Trust and the Lura S. Provost 1993 Trust for a special exception under Section 11.4 of the Wilton Zoning Ordinance has been denied. If granted, the special exception would have permitted the construction of driveways and drainage improvements impacting 9544 square feet of wetlands as part of a proposed subdivision of Lot B–14 (accessed from Cram Hill Road, Lyndeborough).
The application was denied for the following reasons:
The magnitude of the affected wetland area was excessive in absolute terms. It was significantly larger than any wetland crossing that the board has ever approved. The alteration of surface area within the affected wetland areas will potentially have a significant effect on the entire wetland complex which dominates that area of the Town. Almost all the water flowing through the wetlands on the property would have to pass through the impact areas 2 and 4. It is not in the public interest to disturb that large an area. Granting the special exception is not essential to the productive use of the land, because the majority of the total lot is still usable without crossing the wetlands.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, June 7, 2007, and must fully specify all grounds on which the rehearing is requested.
