Tuesday, May 12, 2009 — Notice
Donnie and Daniel Kelley have applied for a special exception under the terms of section 6.6.1 of the Wilton Zoning Ordinance, to permit an in-home pet boarding facility and photography studio as a home occupation on Lot A–10, 12 Tighe Farm Road.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, May 12, 2009 at 7:30 p.m.
The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.
Tuesday, May 12, 2009 — Continuation
The hearing on the application by Donnie and Daniel Kelley for a special exception under the terms of section 6.6.1 of the Wilton Zoning Ordinance has been continued to the Tuesday, June 9 meeting of the Zoning Board. If granted, the special exception would permit an in-home pet boarding facility and photography studio as a home occupation on Lot A–10, 12 Tighe Farm Road.
The Zoning Board has requested that the applicants obtain a written commitment from the Wilton Recycling Center or some other facility that will accept the waste from the boarding facility; that they provide a plan to scale with dimensions showing the lot, house, and yard area to be used by the boarded dogs; that they provide a basement plan to scale with dimensions showing the proposed location of the kennel area, play area, cages, and photography studio; and that they provide documentation with pictures showing the fencing material which they propose to use.
A site visit for the case will be held at 7:00 p.m. on Tuesday, June 2.
Tuesday, June 2, 2009 — Site Visit
The Zoning Board will meet 12 Tighe Farm Road at 7:00 p.m. on Tuesday, June 2, 2009 to hold a site visit for this application.
The site visit is a continuation of the public hearing on the case, and is open to the public. Its purpose is to assist the Board members and other interested parties to become familiar with the property involved in the application. Board members and other interested parties may, through the Board chairperson, ask questions about, and the applicant may point out, site details pertaining to the application, such as boundaries, contours, proposed buffers, driveways, etc. No other testimony will be taken, and no other discussion should occur.
Tuesday, June 9, 2009 — Decision
The application by Donnie and Daniel Kelley for a special exception under the terms of section 6.6.1 of the Wilton Zoning Ordinance has been approved. The special exception will permit an in-home pet boarding facility and photography studio as a home occupation on Lot A–10, 12 Tighe Farm Road. It is subject to the following conditions:
- The boarding facility is for no more than ten dogs.
- The studio is for digital photography — no photographic chemicals will be used.
- There will be a fenced outside exercise area as shown on the scale plan labeled “Kelley and Co Pet Resort” which has been signed by Neil Faiman, the ZBA chairperson, and which is in the ZBA file for the case.
- The fence in front, facing the road, is to be a solid barrier privacy fence, for visual screening and noise abatement.
- The fence in back, facing the woods, is to be wildlife fencing.
- The second driveway shown on the plan is not part of this approval and is not permitted.
- The proposed sign is permitted, subject to the requirements of the Zoning Ordinance pertaining to signs in the General Residence and Agricultural District (section 16.2), with its location subject to approval by the Planning Board.
- This approval is contingent on and becomes effective upons receipt by the ZBA of written confirmation from the Selectmen that the Kelleys can dispose of the dog waste at the Wilton Recycling Center. The 30 day deadline for a motion for rehearing of this case, per RSA 677:2, will begin on the day that the written confirmation is received.
This decision shall expire if the construction or use permitted by it has not begun by Thursday, June 9, 2011. (Wilton Zoning Ordinance section 17.4)
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, July 9, 2009, and must fully specify all grounds on which the rehearing is requested.
