Tuesday, October 13, 2009 — Notice
James K. and Kaye S. Tyler have applied for variances to sections 5.2.1, 5.2.3, 5.3.7, and 7.2.2 of the Wilton Zoning Ordinance, to permit an adjustment of the lot line between Lots K–163 and K–164, 337 Main Street, where both lots are non-conforming now and will remain non-conforming after the lot line adjustment.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing in the Wilton Town Hall Courtroom on Tuesday, October 13, 2009 at 7:30 p.m.
The application for this case, and any other documents submitted with it, are available for inspection in the Wilton Town Offices.
Tuesday, October 13, 2009 — Decision
The application by James K. and Kaye S. Tyler for variances to sections 5.2.1, 5.2.3, 5.3.7, and 7.2.2 of the Wilton Zoning Ordinance has been granted. The variances will to permit an adjustment of the lot line between Lots K–163 and K–164, 337 Main Street, where both lots are non-conforming now and will remain non-conforming after the lot line adjustment, as shown on the plan labeled “Lot Line Adjustment Plan / Lots K–163 and K–164 / James K. Tyler / Kaye S. Tyler / Wilton, New Hampshire / September 17, 2009,” as it may be amended in response to requests from the Wilton Planning Board.
This decision shall expire if the construction or use permitted by it has not begun by Thursday, October 13, 2011. (Wilton Zoning Ordinance section 17.4)
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, November 12, 2009, and must fully specify all grounds on which the rehearing is requested.
