Tuesday, September 14, 2010 — Decision
The application by Kerri Lee Jones for a special exception under the terms of section 5.3.1 of the Wilton Zoning Ordinance, to allow her to run a family daycare in her home on Lot H–29–1–2, 22 Peirce Lane, has been denied. Based on testimony received, the Zoning Board found that the intersection of Abbot Hill Road and Peirce lane is hazardous due to traffic volumes on Abbot Hill Road and limited sight distances; that travel on Peirce Lane is hazardous due to narrowness, steepness, and road conditions from inclement weather during the winter; and that traffic from the proposed daycare would be significantly greater than the existing traffic on Peirce Lane, and would therefore be unreasonably hazardous to clients of the daycare and to residents of the neighborhood. The Board therefore found that granting the Special Exception would be inconsistent with sections 5.3.1(g) and 4.4(e) of the Ordinance.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, October 14, 2010, and must fully specify all grounds on which the rehearing is requested.
