Tuesday, November 18, 2014 — Decision
The application by the Steven and Shan Clark Revocable Trust for a variance to section 6.2.1 of the Wilton Zoning Ordinance has been denied. If granted, the variance would have permitted the addition of a second dwelling unit in the existing house on Lot H–107–5, 10 Samantha’s Way, where the lot size requirements of the Ordinance only allow one dwelling unit. The Zoning Board found that there was no unnecessary hardship, because there was a fair and substantial relationship between the general public purposes of the ordinance provision and the specific application of that provision to the property, and because the hardship was not a consequence of special conditions of the property that distinguish it from other properties in the area.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, December 18, 2014, and must fully specify all grounds on which the rehearing is requested.
