Bethany and Justin Dean have requested variances to sections 5.1(d) and 6.2 of the Wilton Zoning Ordinance to allow a fourth dwelling unit and a second dwelling on Lot K-8, 2 Jowders Drive, where the Ordinance only allows one dwelling and one dwelling unit.
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing on Tuesday, February 8, 2022 at 7:30 p.m. in the Florence Rideout Elementary School Gymnasium, 18 Tremont Street.
Decision
The request by Bethany and Justin Dean for variances to sections 5.1(d) and 6.2 of the Wilton Zoning Ordinance has been denied. If it had been granted, it would have have allowwed a fourth dwelling unit and a second dwelling on Lot K-8, 2 Jowders Drive, where the Ordinance only allows one dwelling and one dwelling unit.
The request was denied because literal enforcement of the provisions of the ordinance would not result in an unnecessary hardship, because the property has no special characteristics which distinguish it from other properties in the General Residence and Agricultural District in such a way as to justify a departure from the density requirements of the ordinance.
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Thursday, March 10, 2022, and must fully specify all grounds on which the rehearing is requested.
