Notice
Forrest Hussey and Pro-Cut, Inc. (owners) and James and Laura LaRue (applicants) have requested a variance to section 5.1 of the Wilton Zoning Ordinance to permit an automobile and light truck repair business on Lot L-27, Intervale Road (The Merit Tool building).
The Town of Wilton Zoning Board of Adjustment will consider this application in a public hearing on Monday, June 14, 1993 at 7:30 p.m. in the Wilton Town Hall Courtroom, 42 Main Street.
Decision
The request by Forrest Hussey and Pro-Cut, Inc. (owners) and James and Laura LaRue (applicants) for a variance to section 5.1 of the Wilton Zoning Ordinance has been granted. It will permit an automobile and light truck repair business on Lot L-27, Intervale Road (The Merit Tool building).
You are hereby notified that the application of James and Laura LaRue for a variance to the terms of Section section 5.1 of the Wilton Zoning Ordinance has been granted.
The variance will permit the use of Lot L-027, Intervale Road (the site of the “Merit Tool” building) in the Residential District for an automobile and light truck repair business.
The application has been granted with the following restrictions:
- Applicants will install solid wooden stockade fencing, at least six feet in height, on sides and rear of property, to be maintained in good condition.
- Customer vehicles to be stored behind the building and inside the fence.
- Temporary parking only to be allowed in front of the building (deliveries, salesmen, customer vehicle drop-off).
- No exterior work allowed except as necessary to make i t possible to move vehicles inside.
- No body work or painting whatsoever.
- Hours of operation: 8 a.m. – 6 p.m. Monday – Friday, 9 a.m. – 3 p.m. Saturday
The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Wednesday, July 14, 1993, and must fully specify all grounds on which the rehearing is requested. Forrest Hussey and Pro-Cut, Inc. (owners) and James and Laura LaRue (applicants) have requested a variance to section 5.1 of the Wilton Zoning Ordinance to permit an automobile and light truck repair business on Lot L-27, Intervale Road (The Merit Tool building).
The Zoning Board will meet on Thursday, July 15, 1993 at 7:30 p.m. in the Wilton Town Hall Courtroom, 42 Main Street to consider a request by multiple neighbors that it hold a new hearing to reconsider its June 14 decision to grant the variance.
The decision on whether to grant a rehearing is made on the basis ofthe written request and and the case record. No additional testimony, evidence, or other input will be taken.
Decision
On June 14, 1993, the Zoning Board of Adjustment of the Town of Wilton voted to grant a variance to James and Laura LaRue and to Forrest Hussey/ProCut, Inc. to permit the use of Lot L-027, Intervale Road, the site of the "Merit Tool Building", for an automobile and light truck repair business.
Robert Landry, Margaret Landry, Helen Egan, Gill Hargrove, Natalie Hodgen, Arthur Hodgen, Paul Schlie, Robin Schlie, James Figlioli, Judy Figlioli, Daniel Ferguson, George Fox, Diane Fox, John Skelly, Elizabeth Skelly, and Paul English submitted a request that the Zoning Board reconsider its approval and rehear the application for a variance, as provided for by RSA 677:2.
In a public meeting on Thursday, July 15, 1993, the Zoning Board unanimously voted to affirm its original decision, and not to rehear the case.
The decision of the Zoning Board may be appealed within 30 days to the Superior Court, as specified in RSA 677:4.
