Case 7/8/03–4
You are hereby informed that the application of L.A. Limousine Service for a Variance to the terms of section 16.2 of the Wilton Zoning Ordinance as applied to Lot L–27, 223 Gibbons Highway, has been granted.
The Board acknowledged that the facts presented and the sign described (and purchased) are identical to those in the previously approved, but expired variances (Cases #6/11/97–2 and #1/14/98). Thus, this variance will permit on a sign that is:
- closer to the highway than otherwise permitted, in line with the stockade fence, tree line and mailbox that does ‘not intrude into the State highway right-of-way;’
- ‘larger than normally allowed’ – the sign is approximately 4.4 feet x 4.0 feet;
- internally lit, illumination is limited to three (3) 30-watt fluorescent tubes and the sign is not to be illuminated between 10:00 PM and sunrise.
Further, applicant must comply with section 16.1 of the Wilton Zoning Ordinance before erecting the sign.
This decision shall expire on Friday, July 8, 2005 if the variance has not been implemented by that date. (Wilton Zoning Ordinance section 17.4)
You are hereby informed that the Zoning Board has granted the request of the Board of Selectmen that they hold a new hearing to reconsider the variance granted to L.A. Limousine Service. The ZBA decided that the public notice for the original hearing was inadequate because it did not correctly identify the sections of the Zoning Ordinance to be varied and the kinds of relief to be granted.
On rehearing, the application will be identified as Case 8/12/03–1.
