Tuesday, April 19, 2005 — Notice

Chalet Susse International, Inc. has appealed the Wilton Planning Board’s denial of an application for a subdivision of Lots C–128–1–1 and C–128–1–2, Keyes Hill Road. The applicant challenges the Planning Board’s interpretation of Section 6.3 of the Wilton Zoning Ordinance with regard to the proposed subdivision.

The public hearing on Chalet Susse International’s appeal of the Wilton Planning Board’s denial of its subdivision application has been continued to the May 10 Zoning Board meeting, so that the Zoning Board can meet with legal counsel to discus the case.

Tuesday, May 10, 2005 — Decision

You are hereby informed that Chalet Susse International’s appeal of the Wilton Planning Board’s denial of an application for a subdivision of Lots C–128–1–1 and C–128–1–2, Keyes Hill Road, has been denied. The Zoning Board upheld the Planning Board’s decision for the reasons that the Planning Board stated in its Notice of Decision, and because the Zoning Board found that the Planning Board had the right to deny the application based on its interpretation of Section 6.3 of the Wilton Zoning Ordinance.

The selectmen, any party to the action or proceedings, or any person directly affected thereby may apply for a rehearing of this decision. A request for a rehearing must be filed in writing with the Zoning Board of Adjustment on or before Wednesday, June 8, 2005, and must fully specify all grounds on which the rehearing is requested. Tuesday, June 14, 2005 — Request for Rehearing

Chalet Susse International, Inc. has requested that the Zoning Board hold a new hearing to reconsider its May 10 decision denying Chalet Susse’s appeal of the Wilton Planning Board’s denial of its application for a subdivision of Lots C–128–1–1 and C–128–1–2, Keyes Hill Road.

The Town of Wilton Zoning Board of Adjustment will meet in the Wilton Town Hall Courtroom on Tuesday, June 14, 2005 at 7:30 p.m. to decide whether to hold the requested rehearing.

The meeting will be open to the public, but the decision will be made on the basis of the written request and the history of the case; no evidence, testimony, or other input will be taken at the meeting.

The request for the rehearing, and any other documents associated with the case, are available for inspection in the Wilton Town Offices.

Tuesday, June 14, 2005 — Decision

On May 10, the Wilton Zoning Board denied Chalet Susse International, Inc.’s appeal of the Wilton Planning Board’s denial of its application for a subdivision of Lots C–128–1–1 and C–128–1–2, Keyes Hill Road. The Zoning Board has now denied Chalet Susse’s request that it hold a rehearing on that appeal. The request for a rehearing was denied because there was no new information in the request that the Board hadn’t already heard.

This decision may be appealed to the superior court on or before Wednesday, July 13, 2005. (N.H. RSA 677:2)
